1. Acceptance of Terms

By accessing or using NyumbaFind ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. NyumbaFind is a rental listing platform connecting landlords and tenants in Kenya.

2. Eligibility

You must be at least 18 years old and a resident of Kenya to use this Platform. By creating an account, you represent and warrant that you have the legal capacity to enter into these terms and comply with all applicable laws and regulations.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate, current, and complete information during registration.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Listing Obligations

As a landlord or property owner using NyumbaFind to list properties, you agree to:

• Provide accurate, truthful, and non-misleading information about the property.
• Upload real photographs of the actual property being listed.
• Accurately describe amenities, including water availability, electricity, and security features.
• Respond to tenant inquiries in a timely manner.
• Update listing status promptly when a property is rented or no longer available.
• Not post duplicate listings for the same property.
• Ensure you have the legal right to list and show the property.

5. Prohibited Conduct

You agree not to:

• Post fraudulent, misleading, or scam listings.
• Use the Platform for any illegal purpose or in violation of Kenyan law.
• Harass, threaten, or discriminate against other users.
• Attempt to circumvent Platform fees or payment systems.
• Scrape, copy, or use Platform data without written permission.
• Interfere with the proper functioning of the Platform.
• Create multiple accounts for the same purpose.
• List properties you do not own or have authority to manage.

6. Listing Accuracy & Verification

While NyumbaFind strives to maintain quality standards, we do not guarantee the accuracy, completeness, or reliability of any listing. Users are encouraged to verify property details independently before entering into any rental agreement. NyumbaFind is not a party to any rental agreement between landlords and tenants.

7. Payment Terms

• Free Platform: NyumbaFind is currently free to use. All services, including listing properties, browsing, and contacting landlords, are provided at no cost during this early growth phase.
• Future Paid Features: We may introduce premium features (such as boosted listings) at a later date. Any paid services will be clearly communicated in advance, with pricing displayed in Kenyan Shillings (KES) inclusive of applicable taxes.
• Rent Payments: NyumbaFind does not process rent payments between tenants and landlords. All rental payments are made directly between parties outside the Platform.

8. Limitation of Liability

To the maximum extent permitted by Kenyan law, NyumbaFind shall not be liable for:

• Any indirect, incidental, special, or consequential damages.
• Loss of profits, data, or business opportunities.
• Disputes between landlords and tenants.
• Accuracy or condition of listed properties.
• Any transactions or agreements made outside the Platform.

Our total liability shall not exceed the amount you paid to NyumbaFind in the 12 months preceding the claim.

9. Intellectual Property

All content on NyumbaFind, including text, graphics, logos, and software, is the property of NyumbaFind or its licensors and is protected by Kenyan and international copyright laws. Users retain ownership of content they upload but grant NyumbaFind a non-exclusive, worldwide license to display and distribute such content on the Platform.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these terms or for any other reason we deem appropriate. Upon termination, your right to use the Platform ceases immediately.

11. Dispute Resolution

These terms are governed by the laws of Kenya. Any disputes arising from these terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to mediation under the rules of the Chartered Institute of Arbitrators (Kenya Branch) before pursuing litigation.

12. Changes to Terms

We may update these Terms of Service from time to time. Material changes will be notified via email or through a prominent notice on the Platform at least 7 days before taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the revised terms.
